Customs officers will visit the applicant's premises on different occasions to verify the accuracy of the information outlined in the application and the implementation of measures required. If situation requires, selective validation on the applicant's business partners may be arranged. C&ED will notify the applicant in advance of the validation visits along with the need for supporting documents.

In accrediting an applicant, C&ED will take into consideration certifications awarded by professional associations like the International Organization of Standardization (ISO), Transported Asset Protection Association (TAPA), etc. However, possession of such certifications will not exempt the applicant from any of the assessment criteria.

In conducting self-assessment, the company should also evaluate those outsourced aspects and indicate if its business partner (such as transportation agent) has complied with the relevant security criterion based on contractual obligation or available declarations.

The duration of accreditation process depends very much on:

1. the completeness of information submitted to C&ED;
2. the complexity of the applicant's business operations; and
3. the number of sites where joint validation may be conducted.

C&ED will have a pre-accreditation meeting with the applicant to discuss the way forward and work out a schedule together.

Duty on liquor is assessed and calculated according to the value of the goods. According to the Dutiable Commodities Ordinance, Chapter 109, Laws of Hong Kong, the value of the goods for assessment of duty shall be the normal price which the goods would fetch, at the relevant time, on their sale in the open market between a buyer and seller independent of each other.

'Relevant time' means in the case of imported goods, the time when such goods are removed from the seller's premises for the purpose of export, or in the case of goods manufactured in Hong Kong, the time when such goods are removed from the premises on which they were manufactured.

C&ED may accept the value of liquors stated in the contract of sale, invoice, book of account, etc., if the date of such documents precedes the date on which the duty is assessed by not more than 12 months.

If

1. the aforesaid documents cannot be produced,

3. the value of the goods stated in the aforesaid documents is not the normal price which the goods would fetch, at the relevant time, on their sale in the open market between a buyer and seller independent of each other,

C&ED may fix a value which shall be deemed to be the value of the goods for the purpose of assessing and calculating duty.

If in any contract of sale, invoice or other document, the value of the liquor is stated in a currency other than Hong Kong dollars, the Hong Kong dollars equivalent of the other currency will be calculated at the opening indicative counter exchange selling (ICES) rate published by the Hong Kong Association of Banks (HKAoB) on the 15th day of the month immediately preceding the month in which the goods are imported. If the rate is not published on the aforesaid day, C&ED shall calculate the Hong Kong dollars equivalent at the ICES rate published by the HKAoB on the immediately preceding working day.

According to the Dutiable Commodities Regulations, Chapter 109A, Laws of Hong Kong, every container containing liquor that is imported into or manufactured in Hong Kong for local consumption shall bear a label on which is printed the alcoholic strength, or the range of alcoholic strength, of the liquor. The label shall include the information needed which is printed legibly in English letters, Chinese characters, Arabic numerals or the symbol "%", or any combination of them. The label shall be securely affixed to or be part of the container and so placed as to be clearly visible.

According to the Dutiable Commodities Ordinance, Chapter 109, Laws of Hong Kong, a cigarette more than 90 mm long, excluding any filter or mouthpiece, shall be treated as if each additional 90 mm or portion of 90 mm were a separate cigarette.

Marked oil is referred to as light diesel oil to which a marker and a colouring substance have been added in the manner and proportion specified by the Dutiable Commodities (Marking and Colouring of Hydrocarbon Oil) Regulations, Chapter 109C, Laws of Hong Kong. An applicant has to fill in the relevant codes (i.e. Supplier code, Carrier code and Commodity Code) when applying for dutiable commodity (DC) permits via the electronic Dutiable Commodities Permit (e-DCP) system of the specified electronic service providers.

To search for the appropriate codes, an applicant can login the e-DCP system of the specified electronic service providers or the C&ED"s Dutiable Commodities System ( https://www.dcs.customs.gov.hk ). If appropriate codes cannot be found, the applicant may contact the Codification Team of C&ED at 3759 2507 to apply for new codes.

According to the Dutiable Commodities Ordinance, Chapter 109, Laws of Hong Kong, zero-rated duty liquors are

1. liquor, other than wine, with an alcoholic strength of not more than 30% by volume measured at a temperature of 20°C; and
2. wine.

No licence and permit is required for the import, export or removal of zero-rated duty liquors.

Repayment of duty is governed by the Dutiable Commodities Ordinance, Chapter 109 and the Dutiable Commodities Regulations, Chapter109A, Laws of Hong Kong. The following lists out the circumstances under which a permittee is entitled to repayment of duty:

• shortages / breakages of duty-paid goods;
• duty overpaid due to incorrect assessment;
• duty paid on denatured spirits or denatured methyl alcohol;
• cancellation of duty-paid permits;
• overpayment of an issued duty-paid permit;
• withdrawal of an un-issued duty-paid permit; and
• wrong payment of an incorrect EDI bill reference number.

The completed application form, together with relevant supporting documents, should be returned to the corresponding unit of the Office of Dutiable Commodities Administration.

The following is a list of documents that are generally required to substantiate the claim of refund / repayment of duty:

• an explanation of the incident and the justification for refund / repayment;
• copies of the permit under claim and executed permit advice;
• purchase order and invoice;
• payment records;
• bill of lading; and
• letters of confirmation from the supplier / bonded warehouse.

The above list is not exhaustive. The successfulness of each claim is judged on its particular circumstances and the claimant may be required to provide further documents upon request by the Department.

Under "Open Bond System" (OBS), no Customs officer is stationed at the bonded warehouses to have real-time supervision on the movement into/out of the warehouse, storage and processing of the dutiable goods. To maintain a balance between trade facilitation and Customs control, the Customs and Excise Department (C&ED) will exercise effective control over bonded warehouses by means of regular excise audits and compliance checks.

The warehouse operators have to furnish to the C&ED the schedule of opening hours when submitting applications of the warehouse licences. If subsequent change of the opening hours as stated in the licence is required, they have to notify the C&ED in writing 4 hours before the change.

Operations on dutiable goods carried out in a bonded warehouse, such as marking, repacking and checking of dutiable goods as well as denaturing of liquors, are known as "Operation in Bond" (OIB).

Traders or their representatives should submit a "Notification of Operation in Bond" (CED 86) to the Excise Compliance and Audit Division of C&ED (Fax: (852) 2481 3011) one day before the OIB begins.

Except with the written permission from the C&ED, OIB must be conducted under Customs supervision.

The "Customs and Excise Warehouse" provides a temporary storage facility for shut-out dutiable cargo outside the opening hours of the "General Bonded Warehouses" and "Public Bonded Warehouses". Traders may make any request for the temporary storage from our Duty Controller on Tel: (852) 3759 2288 (24-hour). In respect of the storage fee, the first 48-hour is free of charge and thereafter $2.3 per package (irrespective of size) is levied per day or part of a day.

Under the circumstances, the dutiable goods should be returned immediately to:

• the bonded warehouse where they were released; or
• a "Public Bonded Warehouse" / "General Bonded Warehouse".

If the dutiable goods cannot be returned to the above mentioned bonded warehouses, they should be returned to the "Customs & Excise Warehouse" for temporary storage.

In general, C&ED would attend excise operations on dutiable goods and some selected duty-paid goods like destruction, sample drawing for laboratory test, checking of markings and denaturing of liquors. If such attendance is required, "Customs appointment" will be imposed as a condition on the permit concerned for traders to observe.

Traders should make application for appointment (CED 383 ) to the Duty Office of the Excise Operation and Support Unit of C&ED (Tel: (852) 2424 4496) by fax (Fax No.: (852) 3525 1290) or through the Electronic System for Dutiable Commodities Permit at least one day in advance of the excise operations.

Fee will not be charged except for supervision of destruction of dutiable goods or attendance specially required by C&ED.

It depends on the terms and conditions imposed on the relevant permit. In general, Customs appointment is not required for vanning / devanning. However, traders are still required to observe the permit conditions imposed and serve "Notification of Devanning / Vanning of Dutiable Goods" (CED 374) to the Excise Compliance and Audit Division of C&ED by fax (Fax No.: (852) 3525 1290) at least 24 hours before the vanning / devanning operation.

The HKSAR Government exercises control on 36 chemicals which can be used for the manufacture of dangerous drugs or psychotropic substances. The control is prescribed in the following schedules of the Control of Chemicals Ordinance (Chapter 145), Laws of Hong Kong.

A licence or a permit is required to:

1. supply, procure, deal in or with any Schedule 1 chemical;
2. possess any Schedule 1 chemical unless it is in transit;
3. manufacture, import or export any Schedule 1 or 2 chemical;
4. move and handle any Schedule 1 or 2 chemical transshipped in Hong Kong; and
5. export any Schedule 3 chemical to any country specified in the same schedule.

For their storage, an approval in writing by the Commissioner of Customs & Excise is required for premises and containers in which Schedule 1 or 2 chemicals are stored or kept.

The applicant must be the proprietor or partner of the company, or a responsible person appointed in writing by the proprietor or partner of the company. For a limited company, the applicant should be a director of the company, or a person authorized in writing by the Board of Directors.

The applicant must be a Hong Kong resident.

An application for a licence under the Control of Chemicals Ordinance should be supported by the following documents:

1. Copy of applicant's Hong Kong Identity Card
2. Copy of Business Registration Certificate
3. Copy of Certificate of incorporation (for limited company)
4. Copy of Registration of Directors (for limited company)
5. Copy of proof of ownership of the premises or tenancy agreement of the business address.

A licence or permit is issued within 14 days upon receipt of all required documents.

No Customs duty or Import/Export levy will be charged for importation of vehicle in Hong Kong. If the vehicle is not for use in Hong Kong (e.g. re-export, scrapping etc.), submission of Import Return (CED336) to the Customs is not necessary. However, the applicant is still required to lodge with the Customs and Excise Department a declaration within 14 days of importation pursuant to the Import and Export (Registration) Regulations, Cap. 60E.

All imported motor vehicles to be used on roads in Hong Kong, whether brand new or used, are subject to the first registration tax for motor vehicles payable at the Transport Department before registration and licensing.

The retail price of a motor vehicle is the aggregate of A1, A2, B and C prices stated on the Published Retail Price list.

A1 - the retail price of standard accessories and warranties (e.g. the installed accessories and manufacturer's / mandatory warranties (if applicable));
A2 - the retail price of optional treatments (e.g. optional painting);
B - the retail price of optional accessories (e.g. optional audio equipment); and
C - the retail price of optional warranties (e.g. optional warranty for 24 months) (A2, B and C are options given to motor vehicle owners)

Vehicle insurance is not included.

The provisional taxable value of a motor vehicle will be assessed by adding up the purchase price, insurance and freight charges, brokerage / agency fees and repair charges related to the purchase and importation of the motor vehicle as declared by the importer. Where the declared value is considered not reflecting the market value of the vehicle in Hong Kong, the Customs and Excise Department may determine other value as taxable value having regard to, but not limited to:

• the age of the motor vehicle; and
• the retail price in the place of origin, including the cost of all materials and work necessary to put the vehicle into the state to meet first registration requirements.

According to section 31(2) of the Prevention of Copyright Piracy Ordinance, the Commissioner of Customs and Excise shall maintain a register on licensees for inspection by members of public.

Including in the register are the name of licensee/company, manufacturing address, licence's valid period, assigned manufacturer's code and types of optical discs manufactured.

At present, the import or export of optical discs, including VCD and CD-R, is not subject to any control. Nevertheless, an importer or exporter must lodge the trade declaration required under the Import ordinance.

Any person, who imports or exports ODMRE, must apply for an import or export licence by completing the stipulated forms (for import - use Form 3(TRA 187); export - use Form 6(TRA394)).

According to the Prevention of Copyright Piracy Ordinance, a licensee must mark the assigned manufacturer's code onto every optical disc manufacturer by him. There is no exemption for CD-R or CD-RW production. Any failure to comply with the condition of marking the manufacturer's code is liable to prosecution.

Using CD-R or CD-RW writer for the copying or recording of data is not subject to control under the Prevention of Copyright Piracy Ordinance. A manufacturer's licence is thus not required. However, it is necessary to ensure that the copying or recording of data is authorised or lawful so as to avoid committing any offence under the Copyright Ordinance.

Hong Kong Registered Wine Exporters may submit advance wine consignment information online and enjoy instant customs clearance upon their consignments" arrival at all 42 Customs districts of the Mainland. In gist, registrants will benefit from speedy customs clearance and greater certainty in the Mainland when re-exporting wine through Hong Kong. Eligible local wine traders and foreign companies operating in Hong Kong may make use of the facilitation measures in tapping the potential of the growing wine market of the Mainland upon successful registration.

Applicants should provide invoices and payment records of substantive business operation in wine. Substantive business operation in wine covers import and export trade, wholesale, retail, logistics and transport, storage and other supporting operation in wine.

Business operation in wine refers to wine operations in Hong Kong. Experience in exporting wine into the Mainland is not mandatory.

HBL file over 10MB should be divided into different parts with size below 10MB. Each part of HBL file, submitted with the corresponding Header file, should be named with the Part No and submitted in a separate email.

1st Email (1st Part)

Header file:
Registration No. + Vessel name + Category Code + Version + Part No.

Participating forwarders are encouraged to submit house level information at their earliest convenience. If house level information is not available at the specified time schedule, Customs may serve Detention Notices, whenever necessary. However, forwarder is still encouraged to submit belated information because Customs will, as far as practicable, check the availability of house level information before issuing a Detention Notice.

Forwarders are required to contact our frontline officers to confirm other means of communication such as fax.
